Heightened Danger for SINTRAINAGRO Leadership In Colombia

The Vice-President of the rural workers union SINTRAINAGRO Guillermo Rivera Zapata has suddenly been deprived of the security measures with which he had previously been provided by the state, which included bodyguards. Guillermo Rivera is now travelling in connection with his union duties in the banana zone of Ci�naga-Magdalena and in the rural areas of C�rdoba and Urab�, areas where the threat of violence is extremely high. According to the interior ministry, the state no longer has the resources to provide security to threatened union leaders and the unions themselves must assume this responsibility.

The risks to trade union leaders in Colombia are sufficiently grave that pressure on the Colombian government is urgently needed to insure the safety of trade unionists threatened with violence. Well over four hundred SINTRAINAGRO leaders and members have been assassinated since 1989. These include Magdalena union leaders Juan Montiel and Emilio Villeras Dur�n, murdered in March 2002, and 7 SINTRAINAGRO banana workers killed on April 26, 2002 at the Montesol Vereda Salsipuedes on the outskirts of Apartado.

We therefore request, as a matter of urgency that you send messages to the President and Interior Minister of Colombia, demanding the immediate restoration of all necessary measures to ensure the safety and well-being of Guillermo Rivera and the leadership of SINTRAINAGRO. It must be made clear to the government that they will be held accountable internationally should the withdrawal of state protection lead to any harm.

Viceordf�randen f�r lantarbetaref�rbundet SINTRAINAGRO, Guillermo Rivera Zapata, har pl�tsligt fr�ntagits det skydd som staten tidigare gav honom, bland annat genom livvakter. Guillermo Rivera befinner sig nu p� fackligt uppdrag i bananplantagezonen Ci�naga-Magdalena och landsbygdsomr�dena C�rdoba och Urab�, d�r v�ldsrisken �r extrem. Enligt inrikesministeriet har staten inte l�ngre tillr�ckliga resurser f�r att kunna skydda hotade fackliga ledare, och fackf�reningarna m�ste sj�lva ta p� sig detta ansvar.

Fackliga ledare i Colombia �r utsatta f�r s� allvarliga risker att det kr�vs p�tryckningar mot Colombias regering f�r att den skall garantera hotade fackliga ledares s�kerhet. Mer �n fyra hundra ledare och medlemmar i SINTRAINAGRO har m�rdats sedan 1989, d�ribland de fackliga ledarna fr�n Magdalena, Juan Montiel och Emilio Villeras Dur�n, som m�rdades i mars 2002, och sju bananarbetare i SINTRAINAGRO, som m�rdades den 26 april 2002 vid Montesol Vereda Salsipuedes i n�rheten av Apartado.

Vi ber er d�rf�r att skyndsamt skicka meddelanden till Colombias president och inrikesminister i vilka ni kr�ver att de omedelbart �terupptar alla n�dv�ndiga �tg�rder f�r att skydda Guillermo Rivera och SINTRAINAGROs ledare. Det m�ste g�ras klart f�r regeringen att den kommer att h�llas till ansvar p� internationell plan om n�gon kommer till skada p� grund av att staten har dragit bort sitt skydd.

Actualmente Guillermo Rivera est� viajando en conexi�n con sus funciones sindicales en la zona bananera de Ci�naga-Magdalena y en las �reas rurales de C�rdoba y Urab�, regiones donde la amenaza de la violencia es extremadamente alta. Seg�n el Ministerio del Interior, el estado ya no cuenta con los recursos para brindar seguridad a los dirigentes sindicales amenazados y son las propias organizaciones sindicales las que deben asumir esta responsabilidad.

Los riesgos que experimentan los dirigentes de los sindicatos en Colombia son suficientemente graves y se necesita urgentemente ejercer presi�n sobre el gobierno colombiano para garantizar la seguridad de los militantes sindicales amenazados por la violencia. Le debe quedar claro al gobierno que ellos ser�n considerados responsables a nivel internacional en caso que la privaci�n de la protecci�n estatal condujera a alg�n perjuicio.

Die IUL hat erfahren, dass die staatlichen Sicherheitsma�nahmen f�r den Vizepr�sidenten der Gewerkschaft der Landarbeiter SINTRAINAGRO Guillermo Rivera Zapata, die auch die Stellung von Leibw�chtern umfassten, v�llig �berraschend aufgehoben wurden. Guillermo Rivera reist gegenw�rtig in Gewerkschaftsangelegenheiten im Bananenanbaugebiet von Ci�naga-Magdalena sowie in den l�ndlichen Gebieten von C�rdoba und Urab�, wo die Gewaltdrohung au�erordentlich hoch ist. Der Regierung muss klargemacht werden, dass sie international verantwortlich gemacht wird, wenn der Entzug des staatlichen Schutzes Folgen haben sollte.

Le vice-pr�sident de l�organisation syndicale rurale SINTRAINAGRO Guillermo Rivera Zapata a soudainement �t� priv� des mesures de s�curit� qui lui �taient auparavant assur�es par le gouvernement; mesures qui comprenaient la pr�sence de gardes du corps. Dans le cadre de ses fonctions, Guillermo Rivera voyage actuellement dans la r�gion banani�re de Ci�naga-Magdalena et les r�gions rurales de C�rdoba et Urab�, o� la menace de violence est extr�mement �lev�e. Selon le minist�re de l�Int�rieur, l��tat n�a plus les ressources n�cessaires pour assurer la s�curit� des chefs syndicaux et ce sont les organisations syndicales elles-m�mes qui doivent se charger de cette responsabilit�.

Les risques courus par les directions syndicales en Colombie sont tellement �lev�s qu�il faut de toute urgence faire pression sur le gouvernement colombien afin qu�il assure la protection des dirigeants/tes syndicaux/cales menac�s/es de violence. Plus de quatre cents dirigeants/tes et membres de SINTRAINAGRO ont �t� assassin�s/es depuis 1989. Protest Violations of Union Rights at PepsiCo Guatemala!

The IUF is requesting international solidarity with the union at PepsiCo's Guatemala franchise, where management is systematically violating trade union rights. Workers at the PepsiCo bottling company La Mariposa are organized by SITRAEMSA, part of the FESTRAS federation affiliated to the IUF.

The previous collective agreement expired at the end of 2000, but rather than meet the union's demand for negotiations to renew the agreement, management used bribes and intimidation to induce members to leave SITRAEMSA. Union officers were reassigned to new work places to isolate them from the rest of the employees. Finally, a large number of union members were sacked.

In November last year, a labour tribunal ordered management to reinstatement the unfairly dismissed workers. The company, however, has refused to implement the reinstatement order, claiming it has not received notification from the court.

Union-busting is nothing new at La Mariposa. When SITRAEMSA applied for official recognition in August 1993, the response was a wave of kidnappings, death threats and other forms of intimidation against union activists. In response to protests by the IUF, its affiliates, and other labour and human rights organizations, PepsiCo denied any wrongdoing on the part of its franchise holder but stated in a letter to the IUF that "If a union is established we expect the bottler will honor it and allow any employees who so desire to join." SITRAEMSA gained legal recognition and a collective agreement, but management is again seeking to eliminate it from the workplace.

Dismissed union members have been holding demonstrations opposite the Presidential Palace in Guatemala City. The union's demands include:

An end to violations of trade union rights;

An end to company interference in internal union affairs;

Immediate reinstatement of the fired workers;

Negotiation of a new collective bargaining agreement;

Payment of the "Seventh Day" (a payment to employees on commission that is required by law).

FESTRAS and the IUF are asking for international solidarity action to defend the workers and their union at the La Mariposa PepsiCo franchise. Initially this should take the form of protesting these abuses to PepsiCo. A sample message to PepsiCo Chairman and CEO Steven S. Reinemund follows below. Dvojica vo�a masovnih prosvjeda odr�anih u sjeveroisto�nom industrijskom kineskom gradu Liaoyangu 15. sije�nja su optu�ena za zlo�in �subverzije� �to bi moglo zavr�iti smrtnom kaznom. Druga dvojica radni�kih vo�a nalaze se u pritvoru, a njihova se prava neprestano kr�e odkad se policija umije�ala kako bi ugu�ila prosvjed u o�ujku pro�le godine. Na svojemu vrhuncu demonstracije u Liaoyangu okupljale su desetke tisu�a radnika. Istovremeno, poduze�e je obustavilo upla�ivanje mirovinskih i zdravstvenih doprinosa za radnike. Tijekom 2000. godine radnici u tvornici zapo�eli su s nizom javnih prosvjeda zbog neispla�enih pla�a, dok je uprava sustavno plja�kala i pronevjeravala tvorni�ke resurse. Slijede�e je godine tvornica proglasila ste�aj. U o�ujku 2002. radni�ke vo�e tvornice su pritvoreni kada je policija okru�ila tvornicu tijekom �pregovora� o ste�aju. Radnici Ferroalloya, zajedno s radnicima drugih tvornica, krenuli su na ceste kada su �elnici komunisti�ke partije objavili na televiziji kako u Liaoyangu nema nezaposlenih. Radnici su nastavili prosvjedovati � uvijek mirno � dok je sve vi�e njihovih vo�a bilo uhi�eno.
�etvorica uhi�enih vo�a prosvjeda po�etno je optu�ena za nezakonito okupljanje: Yao Fuxin, Xiao Yunliang, Pang Qingxiang i Wang Zhaoming. Ipak, dana 15. sije�nja Yao Fuxin i Xiao Yunliang optu�eni su za puno ozbiljniji zlo�in �subverzije�. Njihova kazna jo� uvijek nije javno obznanjena, kao niti to�ne optu�be protiv Panga i Wanga.
Represivne mjere dosad nisu sprije�ile radnike Liaoyanga u iskazivanju solidarnosti sa svojim optu�enim kolegama. �asopis kineskog radni�tva (CLB) sa sjedi�tem u Hong Kongu izvjestio je 15. sije�nja kako
je radnik iz Liaoyanga koji �ivi u blizini suda rekao CLB-u da su jutros policijska vozila blokirala sav automobilski i pje�a�ki promet oko suda u kojemu se vodi proces. Danas ne�to kasnije, drugi je radnik iz tvornice Feroalloy rekao CLB-u kako su radnicima koji nastavljaju s borbom i tra�e osloba�anje Yaoa i druge trojce vo�a o�ujskoga prosvjeda, Xiao Yunlianga, Wang Zhaominga i Pang Qingxianga, danas prekinute telefonske veze. A s obiteljima ovih vo�a u njihovim domovima cijeloga dana nalaze se policajci. Wang, koji je nestao 31. prosinca, sada je ponovno kod ku�e, ali je upozoren da ni skim ne raspravlja o su�enju niti smije komunicirati s drugima.
Sudski postupak protiv �etvorice radni�kih vo�a podr�ala je i slu�bena Svekineska federacija sindikata (ACFTU). Zamjenik predsjednika i glavni tajnik ACFTU-a Zhang Junjiu rekao je na nedavnom Kongresu Komunisti�ke partije kako je Yao Fuxin �provodio napade autima-bombama�, uprkos �injenici �to niti vlasti Liaoyanga, niti Ured za javnu sigurnost Liaoyanga, nisu nikada optu�ili niti jednog prosvjednika za nasilne aktivnosti. U pismu od 10. sije�nja upu�enom predsjedniku ACFTU-a Wangu Zhagou, glavni tajnik ICFTU-a Guy Ryder napisao je kako je �u upravno tijelo Me�unarodne organizacije rada pro�loga lipnja za zamjenskog �lana Radne grupe MOR-a izabran kandidat ACFTU-a. Uprkos tome va�a organizacija kada se suo�i s kineskim radnicima � �tovi�e svojim vlastitim �lanovima � koji se bore za za�titu svojih zakonitih prava, ne samo da odbija progovoriti u njihovo ime i za�tititi optu�ene organizatore, ve� radi i protiv njih.�
Borba se nastavlja; nu�an je me�unarodni pritisak kako bi se pritisnule kineske vlasti da prestanu sa svim sudskim progonima i uznemiravanjima radni�kih vo�a iz Liaoyanga. Pi�em Vam kako bih izrazio-la svoju najdublju zabrinutost zbog su�enja koje je odr�ano 15. sije�nja u Liaoyangu, a na kojemu se sudilo Yao Fuxinu i Xiao Yunliangu za �subverziju�. Njih dvojca, zajedno s Pangom Qingxiangom i Wangom Zhaomingom, uhi�eni su nakon masovnih demonstracija koje su organizirali radnici suprostavljaju�i se korupciji uprave tvornice i tra�e�i isplatu zaostataka pla�a, mirovina i naknada za nezaposlene. Lokalna vlast i policija nisu pru�ili nikakve dokaze nasilja; ljudi su ustvari krivi samo zato �to su tra�ili prakticiranje njihovih demokratskih i sindikalnih prava koja im jam�e me�unarodni ugovori i konvencije MOR-a.
Stoga Vas pozivamo da odbacite sve optu�be i osude protiv �etvorice mu�karaca i da zaustavite sva zastra�ivanja i uznemiravanja radnika uklju�enih u liaojang�ke prosvjede i njihovih obitelji.

Poja�ana opasnost za vodstvo kolumbijskog sindikata SINTRAINAGRO

Podpredsjednik sindikata seoskih radnika SINTRAINAGRO Guillermo Rivera Zapata iznenada je li�en mjera sigurnosti koje mu je prije toga pru�ala dr�ava, a koje su uklju�ivale i tjelohranitelje. Guillermo Rivera sada putuje zbog svojih sindikalnih du�nosti po banana zoni Ci�naga-Magdalena i ruralnim podru�jima Kordobe i Urabe, po podru�jima u kojima je opasnost od nasilja ekstremno visoka. �lanovima Izvr�nog odbora nacionalne sredi�njice CUT, uklju�iv�i i novoizabranog predsjednika Carlos Rodr�gueza, tako�er je povu�ena za�tita. Prema rije�ima ministra unutra�njih poslova dr�ava vi�e nema sredstava za pru�anje za�tite ugro�enim sindikalnim �elnicima i sindikalisti za svoju za�titu moraju sami snositi odgovornost.
Rizik kojemu se izla�u sindikalni �elnici u Kolumbiji dovoljno je ozbiljan da bi se izvr�io �urni pritisak na kolumbijsku vladu kako bi zajam�ila sigurnost sindikalistima koje ugro�ava nasilje. Vi�e od �etiri stotine sindikalnih vo�a i �lanova SINTRAINAGROa ubijeno je od 1989. Me�u njima su i sindikalni �elnici Magdalene, Juan Montiel i Emilio Villeras Dur�n, ubijeni u o�ujku 2002., kao i 7 radnika s planta�e banana � �lanova SINTRAINAGROa - ubijenih 26. travnja 2002. u Montesol Vereda Salsipuedes, predgra�u Apartada.
Stoga tra�imo da pod hitno po�aljete pisma predsjedniku i ministru unutra�njih poslova Kolumbije, zahtjevaju�i da odmah vrate sve mjere nu�ne za za�titu i sigurnost Guillerma Rivere te �elni�tva CUT-a i njezinih �lanica. Vladi mora biti jasno kako �e ih svijet dr�ati odgovornima ako njihovo povla�enje dr�avne za�tite dovede do bilo kakve �tete.

He recibido con gran alarma la noticia de que el Vicepresidente de la organizaci�n sindical de trabajadores rurales SINTRAINAGRO, Guillermo Rivera Zapata, as� como los miembros del Comit� Ejecutivo de la CUT, incluyendo el presidente, Luis Rodr�guez han sido s�bitamente privados de las medidas de seguridad que antes les hab�a prestado el estado. Como sin duda usted conoce, m�s de cuatrocientos dirigentes y miembros de SINTRAINAGRO han sido asesinados desde 1989. �stos incluyen dirigentes sindicales de Magdalena, Juan Montiel y Emilio Villeras Dur�n, muertos en marzo del 2002, as� como 7 trabajadores del banano de SINTRAINAGRO asesinados el 26 de abril del 2002 en Montesol Vereda Salsipuedes en las afueras de Apartado. Actualmente Guillermo Rivera est� viajando en conexi�n con sus funciones sindicales en la zona bananera de Ci�naga- Magdalena y en las �reas rurales de C�rdoba y Urab�. Es evidente el riesgo de su seguridad y bienestar y, sin embargo, el gobierno ha elegido este momento para retirarle el conductor, veh�culo y sus escoltas, que el Ministerio del Interior le hab�a provisto, con buenas razones, desde el año 2000.

En consecuencia, le insto a actuar inmediatamente para asegurar que se preste al Sr. Rivera y a los dirigentes de la CUT y sus afiliados toda la protecci�n apropiada necesaria seg�n la situaci�n. El gobierno de Colombia deber� rendir cuentas a la opini�n publica internacional ante cualquier eventual riesgo que corriera ya sea el Sr. Rivera y/o cualquiera de los dirigentes de la CUT a partir del momento que el estado les retire las medidas de seguridad tan necesarias.

Protestera mot kr�nkningar av de fackliga r�ttigheterna p� PepsiCo i Guatemala!

IUL kallar till internationella solidaritetsaktioner till f�rm�n f�r fackf�reningen p� PepsiCos guatemalanska franchisef�retag, d�r ledningen systematiskt kr�nker de fackliga r�ttigheterna. De anst�llda p� PepsiCo-tappningsf�retaget La Mariposa organiseras av SITRAEMSA, som ing�r i IUL-f�rbundet FESTRAS.

Det senaste kollektivavtalet l�pte till slutet av �r 2000, men i st�llet f�r att tillm�tesg� fackf�reningens beg�ran om nya f�rhandlingar f�rs�kte f�retagsledningen med hj�lp av mutor och hotelser f�rm� medlemmarna att l�mna SITRAEMSA. Fackliga funktion�rer placerades p� nya arbetsplatser d�r de var isolerade fr�n de �vriga arbetstagarna. Slutligen avskedades ett stort antal medlemmar.

I november 2002 beordrade en arbetsdomstol f�retaget att �terins�tta anst�llda som hade avskedats utan sakligt sk�l. F�retaget v�grade dock att �tlyda beslutet, p� grundval av att man inte hade f�tt n�gon anm�lan fr�n domstolen.

Antifackliga �tg�rder �r inget nytt p� La Mariposa. N�r SITRAEMSA formellt ans�kte om f�rhandlingsr�tt i augusti 1993 m�ttes man av en v�g av kidnappningar, mordhot och andra hotelser mot fackliga aktivister. Som svar p� protesterna fr�n IUL, medlemsf�rbunden och andra fackf�reningar och m�nniskor�ttsorganisationer f�rnekade PepsiCo att franchisef�retaget skulle ha betett sig f�rkastligt, och skrev i ett brev till IUL att "om det har bildats en fackf�rening �r vi �vertygade om att tappningsf�retaget kommer att respektera den och till�ta alla anst�llda som �nskar det att ansluta sig." SITRAEMSA fick sin f�rhandlingsr�tt och sitt kollektivavtal, men f�retagsledningen f�rs�ker nu �terigen att driva bort f�reningen fr�n arbetsplatsen.

Avskedade medlemmar har demonstrerat utanf�r presidentpalatset i Guatemala City. De kr�ver bland annat:

ett slut p� kr�nkningarna av de fackliga r�ttigheterna

att f�retaget slutar att blanda sig i fackf�reningens interna angel�genheter

att de avskedade arbetstagarna omedelbart �terins�tts

en �verenskommelse om ett nytt f�rhandlingsavtal

betalning av "sjundedagsers�ttning" (en ers�ttning till anst�llda p� uppdrag som f�reskrivs i lagen).

FESTRAS och IUL uppmanar till internationella sympati�tg�rder f�r att f�rsvara arbetstagarna och deras fackf�rening p� PepsiCos franchisef�retag La Mariposa. Vi har av IUL informerats om st�ndiga och systematiska kr�nkningar av de fackliga r�ttigheterna p� Embotteladora La Mariposa (ett Pepsi Cola-franchisef�retag i Guatemala).

Ledningen f�r La Mariposa har v�grat att f�rhandla om ett nytt kollektivavtal med fackf�reningen SITRAEMSA, den har bedrivit en kampanj f�r att f�rm� anst�llda att g� ur fackf�reningen, den har trakasserat fackliga ledare, den har avskedat ett stort antal medlemmar i fackf�reningen, samt v�grat att r�tta sig efter arbetsdomstolens beslut om att de skall �terins�ttas.

Detta �r inte f�rsta g�ngen som IUL har m�st ingripa p� grund av tvister p� La Mariposa. Det var endast efter en internationell protestkampanj 1994 som SITRAEMSA tillerk�ndes f�rhandlingsr�tt och ett f�rsta kollektivavtal kunde f�rhandlas fram.

Vi ber er att uppmana ert franchisef�retag i Guatemala att g� med p� fackf�reningens legitima krav, bland andra:

Protestiert gegen Verletzungen der Gewerkschaftsrechte bei PepsiCo Guatemala!

Die IUL fordert zur internationalen Solidarit�t mit der Gewerkschaft beim PepsiCo-Konzession�r in Guatemala auf, dessen Leitung systematisch Gewerkschaftsrechte verletzt. Die Arbeitnehmer des PepsiCo-Abf�llers La Mariposa geh�ren der SITRAEMSA an, die ihrerseits dem IUL-Mitgliedsverband FESTRAS angeschlossen ist.

Der alte Tarifvertrag lief Ende 2000 aus, doch statt der Forderung der Gewerkschaft nach Verhandlungen �ber einen neuen Vertrag zu entsprechen, versuchte die Unternehmensleitung, durch Bestechung und Einsch�chterung Mitglieder zum Ausstrit aus der SITRAEMSA zu veranlassen. Gewerkschaftsbeauftragte wurden an neue Arbeitspl�tze versetzt, um sie von den �brigen Arbeitnehmern zu isolieren. Schlie�lich wurden zahlreiche Gewerkschaftsmitglieder entlassen.

Im November vorigen Jahres wies ein Arbeitsgericht die Unternehmensleitung an, die zu Unrecht entlassenen Arbeitnehmer wiedereinzustellen. Das Unternehmen hat sich jedoch der Wiedereinstellungsanweisung widersetzt und behauptet, es habe vom Gericht keine entsprechende Mitteilung erhalten.

Gewerkschaftsfeindlichkeit ist bei La Mariposa nichts Neues. Als die SITRAEMSA im August 1993 die Anerkennung beantragte, folgte eine Welle von Entf�hrungen, Todesdrohungen und anderen Einsch�chterungsversuchen gegen Gewerkschaftsaktivisten. Als Reaktion auf Proteste der IUL, ihrer Mitgliedsverb�nde und anderer Arbeitnehmer- und Menschenrechtsorganisationen bestritt PepsiCo jedes Fehlverhalten seines Konzession�rs, erkl�rte jedoch in einem Schreiben an die IUL: "Wenn eine Gewerkschaft gegr�ndet wird, gehen wir davon aus, da� der Abf�ller sie respektieren und Arbeitnehmern, die dies w�nschen, den Beitritt erlauben wird." Die SITRAEMSA erhielt ihre Anerkennung und setzte einen Tarifvertrag durch, doch die Unternehmensleitung versucht erneut, sie aus dem Betrieb zu entfernen.

Entlassene Gewerkschaftsmitglieder haben vor dem Pr�sidentenpalast in Guatemala City demonstriert. Die Forderungen der Gewerkschaft lauten:

Ein Ende der Verletzungen von Gewerkschaftsrechten;

Ein Ende der Einmischung des Unternehmens in interne Gewerkschaftsangelegenheiten;

Unverz�gliche Wiedereinstellung der entlassenen Arbeitnehmer;

Verhandlungen �ber einen neuen Tarifvertrag;

Zahlung des "siebenten Tages" (eine gesetzlich vorgeschriebene Leistung).

Die FESTRAS und die IUL bitten um internationale Solidarit�tsaktionen zur Verteidigung der Arbeitnehmer des PepsiCo-Konzession�rs La Mariposa und ihrer Gewerkschaft. Zun�chst sollten diese Aktionen in Form von Protesten gegen diese Mi�st�nde an den PepsiCo-Konzern selbst erfolgen. Nachstehend folgt eine Musterbotschaft an den PepsiCo-Konzernchef Steven S. Die IUL hat uns �ber die st�ndigen und systematischen Verletzungen von Gewerkschaftsrechten bei der Embotelladora La Mariposa (Pepsi-Cola Konzessionsunternehmen in Guatemala) unterrichtet.

Die Unternehmensleitung von La Mariposa hat es abgelehnt, mit der Gewerkschaft SITRAEMSA �ber einen neuen Tarifvertrg zu verhandeln. Sie hat statt dessen eine Kampagne eingeleitet, um Arbeitnehmer zum Austritt aus der Gewerkschaft zu veranlassen. Sie hat Gewerkschaftsf�hrer benachteiligt und eine gro�e Zahl von Arbeitnehmern, die der Gewerkschaft angeh�ren, ungerechtfertigt entlassen und sich dar�ber hinaus geweigert, der Anweisung des Arbeitsgerichts, diese Arbeitnehmer wieder einzustellen, nachzukommen.

Es ist dies nicht das erste Mal, dass die IUL bei La Mariposa intervenieren muss. Erst 1994 bedurfte es einer internationalen Protestkampagne, ehe die SITRAEMSA anerkannt wurde und ein erster Tarifvertrag ausgehandelt werden konnte.

Wir bitte Sie, Ihr Konzessionsunternehmen in Guatemala aufzufordern, die folgenden legitimen Forderungen der Gewerkschaft zu erf�llen:

"Radnici ka�u NE �lanku 23!" Masovne demonstracije 15. prosinca protiv predlo�enog antisubverzivnog zakonodavstva u Hong Kongu � jedna od mnogih javni aktivnosti.

Prijedlozi su sadr�ani u vladinu �konzultacijskom dokumentu� u �Prijedlozima za primjenu �lanka 23. Osnovnoga zakona� koji tvrdi kako �e HKSAR

samostalno provoditi zakone koji zabranjuju djela izdaje, otcjepljenja, pobune, subverzije protiv Sredi�nje narodne vlade, ili otkrivanja dr�avnih tajni; zabranjuju stranim politi�kim organizacijama ili tijelima provo�enje politi�kih aktivnosti u Regiji, te zabranjuju politi�kim organizacijama ili tijelima Regije uspostavu veza sa stranim politi�kim organizacijama ili tijelima.

Vladin prijedlog koji je predstavljen u rujnu pro�le godine za tromjese�nih �konzultacija�, o�tro govori o �nacionalnoj sigurnosti�, �pobuni�, � poticaju na neposlu�nost prema zakonima ili nekom zakonitom poretku� i �odavanju dr�avnih tajni�. Prijedlog bi sredi�njim vlastima Kine dao mo� da �odlu�i predstavlja li hongkon�ka organizacija prijetnju nacionalnoj sigurnosti�. Prijedlog definira organizaciju kao buntovni�ki prekr�aj �koji poti�e druge na stvaranje javnih nereda, �to ugro�ava stabilnost HKSAR-a, a me�u takve buntovni�ke prekr�aje spadaju tiskanje, izdavanje, distribucija, prikazivanje ili reprodukcija buntovni�kih publikacija�. Definicija subverzije uklju�uje �ujedinjenje snaga sa strancem, s namjerom da se svrgne PRCG (vlasti u Kini); ili prisili PRCG da promijeni mjere kojima se slu�i�. Kineska vlada mogla bi zabraniti svaku hongkong�ku organizaciju za koju dr�e da je �lanica ili na neki na�in povezana s kineskom mati�nom organizacijom koju su proglasili opasno��u za �nacionalnu sigurnost�. Vladin dokument predla�e drasti�no pove�anje policijske mo�i kako bi se provele ove odredbe.

HKCTU je osudio prijedloge �lanka 23. kao �politi�ko oru�e za u�utkavanje svih oblika vladine oporbe uklju�uju�i sindikalno i radni�ko suprostavljanje vladinom antiradni�kom i antisindikalnom djelovanju�. Zakoni na kojima se temelje ovi prijedlozi koriste se za podizanje tu�bi protiv radnika kada se bune zbog uvjeta ili kad tra�e osnivanje nezavisnog sindikata u Kini. Trenutno, Yao Fuxin i Xia Yunliang, dvojca aktivista za radni�ka prava uhi�enih zbog u�estvovanja u masovnim prosvjedima pro�le godine u Liaoyangu (Provincija Liaoning), optu�eni su za zlo�in �subverzije� za koji se ka�njava do�ivotnim zatvorom ili smrtnom kaznom.

Dr�avno kontrolirana Svekineska federacija sindikata (ACFTU) umjesto da brani ove pojedince i tisu�e radnika Liaoyanga koji su se ujedinili u javnim demonstracijama za svoja prava, podr�ala je vladine optu�be. Stoga vladini predlo�eni �antisubverzivni� zakoni predstavljaju nametanje kineskih zakona (i represije) Hong Kongu, u izrazitom kr�enju pricipa �Jedna zemlja � dva sustava�. Ukoliko se primjene, prijedlozi bi mogli ukinuti demokratska prava i slobode te ugroziti samo postojanje nezavisnih sindikata. Sada kada je zavr�io �konzultacijski period� vlada bi mogla ove godine po�eti s primjenom prijedloga.

Protestez contre les violations des droits syndicaux chez PepsiCo au Guatemala!

L'UITA lance un appel � la solidarit� internationale en faveur de l'organisation syndicale repr�sentant les travailleurs/euses de l'embouteilleur franchis� de PepsiCo au Guatemala, dont la direction viole syst�matiquement les droits syndicaux. Ces travailleurs/euses sont repr�sent�s/es par SITRAEMSA, membre de la f�d�ration FESTRAS, affili�e � l'UITA.

La convention collective a expir� � la fin de l'ann�e 2000. Plut�t que de r�pondre � l'invitation d'entreprendre des n�gociations lanc�e par le syndicat, la direction a pr�f�r� user de paiements illicites et d'intimidation afin d'inciter les membres � quitter le SITRAEMSA. Les dirigeants/tes du syndicat on �t� affect�s/es � de nouveaux postes de travail afin de les isoler des autres travailleurs/euses. Enfin, un grand nombre de membres du syndicat ont �t� licenci�s/es.

En novembre dernier, un tribunal du travail a ordonn� la r�int�gration des travailleurs/euses injustement licenci�s/es. La soci�t� a toutefois refus� de se conformer � l'ordre de r�int�gration, affirmant ne pas en avoir �t� inform�e par le tribunal.

Le recours aux pratiques antisyndicales n'est pas nouveau � La Mariposa. La demande de reconnaissance officielle d�pos�e par SITRAEMSA avait �t� accueillie par une vague d'enl�vements, de menaces de mort et d'autres formes d'intimidation � l'endroit des activistes syndicaux/cales. En r�ponse aux protestations de l'UITA, de ses affili�es et d'organisations des droits humains, PepsiCo avait ni� toute mauvaise action de la part du franchis� tout en affirmant, dans une lettre � l'UITA, �qu'advenant la cr�ation d'un syndicat, nous attendons du franchis� qu'il le reconnaisse et permette aux employ�s/es qui le souhaitent d'y adh�rer�. Pourtant, et bien que SITRAEMSA ait obtenu la reconnaissance l�gale et n�goci� une convention collective, la direction tente � nouveau de le chasser du milieu de travail.

Les membres licenci�s/es du syndicat ont organis� des manifestations devant le Palais pr�sidentiel dans la ville de Guatemala. Le syndicat demande entre autres:

la fin des violations des droits syndicaux;

la fin de l'ing�rence de l'employeur dans les affaires internes du syndicat;

la r�int�gration imm�diate des travailleurs/euses licenci�s/es;

la n�gociation d'une nouvelle convention collective;

le paiement du �septi�me jour� (un paiement qui doit selon la loi �tre fait aux employ�s r�mun�r�s � la commission).

FESTRAS et l'UITA demandent une action de solidarit� internationale afin de d�fendre les travailleurs/euses du franchis� PepsiCo de La Mariposa et leur syndicat. �Protestemos contra las Violaciones de los Derechos Sindicales en PepsiCo Guatemala!

La UITA est� instando a la solidaridad internacional en favor de la organizaci�n sindical en la concesionaria de PepsiCo en Guatemala, donde la gerencia est� violando sistem�ticamente los derechos sindicales. Los/as trabajadores/as en la compa��a embotelladora de PepsiCo, La Mariposa, est�n organizados por SITRAEMSA, que forma parte de la federaci�n FESTRAS, afiliada a la UITA.

El convenio colectivo anterior expir� a fines del a�o 2000, pero en lugar de aceptar la demanda del sindicato a los efectos de entablar negociaciones para renovar el convenio, la gerencia utiliz� sobornos e intimidaciones para inducir a los miembros a abandonar SITRAEMSA. Los directivos sindicales fueron reasignados a nuevos lugares de trabajo para aislarlos del resto de los/as empleados/as. Por �ltimo, un gran n�mero de miembros sindicales fueron echados.

En noviembre del a�o pasado, un tribunal laboral orden� a la gerencia la restituci�n de los/as trabajadores/as despedidos injustamente. Sin embargo, la compa��a ha rehusado poner en pr�ctica la orden de reinstalaci�n, alegando que no ha recibido la notificaci�n de la corte.

La represi�n sindical no es algo nuevo en La Mariposa. Cuando SITRAEMSA solicit� el reconocimiento oficial en agosto de 1993, la respuesta fue una ola de secuestros, amenazas de muerte y otras formas de intimidaci�n contra los militantes sindicales. Como reacci�n a las protestas de la UITA, de sus afiliadas y de otras organizaciones de derechos laborales y humanos, PepsiCo neg� toda acci�n il�cita por parte de su concesionaria, pero afirm� en una carta a la UITA que "Si se establece una organizaci�n sindical, esperamos que la embotelladora la respete y permita que se adhieran todos/as los/as empleados/as que as� lo deseen". SITRAEMSA logr� el reconocimiento jur�dico y un convenio colectivo, pero nuevamente la gerencia est� procurando eliminarla del lugar de trabajo.

Los miembros sindicales despedidos han estado realizando manifestaciones frente al Palacio Presidencial en Ciudad de Guatemala. Las exigencias de la organizaci�n sindical comprenden:

El cese a las violaciones de los derechos sindicales;

La no ingerencia de la empresa en el quehacer sindical;

La inmediata reinstalaci�n de los/as trabajadores/as despedidos;

La negociaci�n de un nuevo pacto de negociaci�n colectiva;

El pago del "S�ptimo D�a" (un pago a los/as empleados/as en comisi�n que es obligatorio por ley).

FESTRAS y la UITA est�n instando a una acci�n de solidaridad internacional para defender a los/as trabajadores/as y su sindicato en la concesionaria La Mariposa de PepsiCo. This is not the first time that the IUF has had to intervene at La Mariposa. It was only in 1994 after an international protest campaign that the SITRAEMSA union was recognized and an initial collective agreement negotiated.

We ask that you urge your franchise in Guatemala to agree to the union's legitimate demands, which include:

An end to violations of trade union rights;

An end to company interference in internal union affairs;

Immediate reinstatement of the fired workers;

Negotiation of a new collective bargaining agreement;

PepsiCo in India � leading the �cola race to the bottom�?

Growing union repression and intense pressure from management on the remaining unionised Pepsi bottling plants is the clear picture that emerges from a recent IUF study of PepsiCo bottling operation in India.

Incidents at PepsiCo plants in India include police being invited in by the company management to physically beat up unionised workers and constant threats of dismissal when workers start the process of organizing a union in the many plants were unions currently do not exist or where they want to exercise bargaining rights where they do.

Against a background of systematic repression of worker rights that appears to extend far more widely than in India alone, IUF general secretary Ron Oswald commented,

�Given the intense interest in worker rights in Coca Cola production facilities around the world we should not forget that PepsiCo appears to be denying these rights as much if not more systematically in many of its facilities around the world.�

Oswald further noted that, �Coca-Cola may on occasions present serious problems to a significant number of our members, however the PepsiCo corporation appears even more determined to systematically deny these rights throughout its system. The result is generally significantly lower levels of unioization in PepsiCo compared to Coca-Cola bottlers around the world. We must bear this in mind as we try to both defend and extend rights acquired within Coca-Cola. Ignoring PepsiCo�s more serious abuses of basic rights could give them a dangerously competitive advantage over Coca-Cola, an advantage built on a more systematic and intense repression of basic rights. The IUF will continue to investigate PepsiCo as part of our permanent effort to bring respect, dignity and rights to workers throughout the world massive soft drinks sector.�

Support IUF Urguayan Affiliate Fighting AmBev Brewery Closure

The Brazilian-based TNC AmBev, one of the top four global breweries, has announced its decision to close the NORTE�A brewery in Paysand� (400 km. from Montevideo), which it acquired only in 2000.

Nearly 200 workers are directly employed at this brewery, which has been a mainstay of the local economy for 50 years. Uruguay has an unemployment rate of 22%, and the Paysand� region has been heavily affected by other plant closings.

The IUF-affiliated union Sindicato de Obreros y Empleados de Norte�a (SOEN) is carrying out an extensive public campaign that has gained widespread support. On 12 February 2500 persons created a "solidarity embrace" surrounding the plant, joined by contingents from the IUF, affiliates from Uruguay and Brazil, and from the Brazilian labour federation CUT.

The IUF Latin American Region has also joined in the collection of signatures on petitions demanding that the brewery be kept open (more than 20,000 to date), and IUF affiliates throughout the region are sending protest messages to AmBev and to the government of Uruguay.

Coca-Cola union in India breaks new bargaining ground and fights off outsourcing

In January the union representing Coca-Cola workers at the Nasik bottling plant in Maharastra State signed a new collective agreement that pushed forward workers� conditions in a meaningful way.

Wages were raised but were supplemented by bonus agreements largely doubling the average achieved in virtually all industrial plants in the State. A new canteen facility was also agreed, the first ever at the plant in a region where such facilities are not commonly provided.

However perhaps the most significant achievement came in the area of employment. In addition to securing permanent employment status for a significant number of previously casually employed workers from 2004 the union successfully confronted proposals from the company to insert a clause in the agreement that would have given them extensive rights to introduce outsourcing and contract labour. The union was determined not to accept such a clause and delayed the signing of the agreement by some months to keep it out. Eventually the company withdrew their proposal and the agreement was singed in January.

This information was shared with the steering committee of the All India Coca-Cola Workers Forum a recently created national body bringing together unions representing Coca-Cola workers throughout India.

The All India Coca-Cola Forum leadership meet with IUF general and regional secretaries, Ron Oswald and Ma Wei Pin. IUF South Asia Coordinator Meena Patel also joined the meeting

The Forum will be represented at the coming global meeting for Coca-Cola unions organized by the IUF in New York on March 3 and 4 this year.

Norte�a: La Lucha Sindical por el Empleo en Uruguay

La transnacional brasile�a AmBev, la cuarta productora de cerveza en el mundo, ha decidido cerrar la planta de NORTE�A en Paysand� (ubicada a 400 Km. de Montevideo), la cual fue adquirida en el a�o 2000.

Cerca de 200 trabajadores/as dependen en forma directa de esta f�brica, que ha sido al alma de la econom�a local durante los �ltimos 50 a�os, en un pa�s donde el desempleo alcanza un 22% en la regi�n de Paysand� que es una de las m�s castigadas por el cierre de plantas y emprendimientos econ�micos.

Nuestra afiliada el Sindicato de Obreros y Empleados de Norte�a (SOEN), viene realizando una importante campa�a de sensibilizaci�n p�blica que cuenta con un amplio respaldo popular. El 12 de febrero pasado, 2.500 personas crearon un "abrazo solidario" rodeando la f�brica, entre las cuales se encontraban representantes de UITA, afiliadas de Uruguay y Brasil y de la Central Unica de Trabajadores (CUT-Brasil).

La Secretar�a Regional Latinoamericana de la UITA, ha iniciado una campa�a de recolecci�n de firmas para que la f�brica siga abierta, hasta el d�a de hoy m�s de 20.000 firmas han sido recogidas. Al mismo tiempo, las afiliadas a la UITA a lo largo de la regi�n, est�n enviando mensajes de protesta a AmBev y al gobierno de Uruguay.

En nombre de los 3 millones de trabajadores de 124 pa�ses, sindicalizados en las 344 organizaciones afiliadas a la UITA, protestamos en�rgicamente contra esta decisi�n que priva de empleo a casi 200 asalariados/as de esta f�brica. De igual modo, esta decisi�n repercutir� terriblemente sobre una regi�n donde la tasa de desempleo se eleva al 22% de la poblaci�n activa y tendr� sin dudas, graves consecuencias sobre la actividad econ�mica y sobre el empleo en los otros sectores.

Por consecuencia, le solicitamos encarecidamente reconsiderar urgentemente esta decisi�n y encontrar una soluci�n que permita mantener activa la f�brica de Norte�a en Paysand�.

La UITA sostiene a pleno la lucha de los/as trabajadores/as de la Norte�a y de su sindicato, el Sindicato de Obreros y Empleados de Norte�a.

AmBev (Uruguay): Nedl�ggning av Norte�a-bryggeriet

Det brasilianska transnationella f�retaget AmBev, ett av v�rldens fyra st�rsta bryggerif�retag, har kungjort sitt beslut att l�gga ned Norte�a-bryggeriet i Paysand� (400 km fr�n Montevideo), som f�retaget f�rv�rvade s� sent som �r 2000.

N�stan 200 personer arbetar p� detta bryggeri, som har varit en viktig arbetsgivare i den lokala ekonomin under 50 �r. Uruguay har en arbetsl�shet p� 22 %, och Paysand�regionen har drabbats h�rt av andra nedl�ggningar.

IUL-f�rbundet Sindicato de Obreros y Empleados de Norte�a (SOEN) h�ller p� att genomf�ra en omfattande offentlig kampanj, som har f�tt ett brett st�d. Den 12 februari genomf�rde 2500 personer en "solidaritetsomfamning", d� de omringade anl�ggningen, varvid kontingenter fr�n IUL, medlemsf�rbund i Uruguay och Brasilien och fr�n den brasilianska huvudorganisationen CUT deltog.

Unterst�tzung des Gewerkschaftskampfes gegen Brauereischlie�ung

Der in Brasilien beheimatete und zu den vier gr��ten Brauereien der Welt z�hlen-de Konzern AmBev k�ndigte die Schlie�ung der NORTE�A Brauerei in Paysand� (400 km von Montevideo entfernt) an, nachdem er sie erst im Jahr 2000 erwor-ben hatte.

Die Brauerei, die seit 50 Jahren eine Hauptst�tze der lokalen Wirtschaft bildet, besch�ftigt 200 Arbeitnehmer und Arbeitnehmerinnen. In Uruguay liegt die Ar-beitslosigkeit derzeit bei 22%, wobei die Region Paysand� bereits von anderen Werksschlie�ungen schwer betroffen ist.

Der IUL-Mitgliedsverband Sindicato de Obreros y Empleados de Norte�a (SOEN) f�hrt nun eine gro� angelegte �ffentliche Kampagne durch, die bereits gro�e Un-terst�tzung erh�lt. So versammelten sich am 12. Februar 2.500 Menschen und bildeten einen �Solidarit�tsring� um das Werk, dem sich Abordnungen der IUL, der Mitgliedsorganisationen aus Uruguay und Brasilien und des brasiliani-schen Gewerkschaftsbunds CUT anschlossen.

Gleichzeitig unterst�tzt die lateinamerikanische Regionalorganisation der IUL die Unterschriftenkampagne f�r eine Petition, mit der die Aufrechterhaltung des Be-triebs gefordert wird (bislang wurden �ber 20.000 Unterschriften gesammelt), w�hrend IUL-Mitgliedsverb�nde aus der gesamten Region Protestschreiben an AmBev und an die Regierung von Uruguay verschicken.

AmBev, l�une des quatre plus grandes soci�t�s transnationales du secteur des brasseries, dont le si�ge est au Br�sil, a annonc� sa d�cision de fermer la brasserie NORTE�A situ�e � Paysand� (400 km. de Montevideo), qu�elle avait rachet�e en 2000.

Pr�s de 200 salari�s/es sont directement employ�s/es par la brasserie qui a �t� un �l�ment essentiel de l��conomie locale ces 50 derni�res ann�es. Le taux de ch�mage en Uruguay atteint 22% et la r�gion de Paysand� a d�j� �t� durement touch�e par d�autres fermetures d�usines.

L�affili�e de l�UITA Sindicato de Obreros y Empleados de Norte�a (SOEN) a pris l�initiative d�une vaste campagne aupr�s de l�opinion publique qui a eu un large �cho. Le 12 f�vrier dernier, 2500 personnes ont cr�� une � cha�ne de solidarit� � autour de l�usine � laquelle ont particip� des camarades des affili�es de l�UITA en Uruguay et au Br�sil ainsi que des repr�sentants de la centrale nationale br�silienne CUT.

Le secr�tariat r�gional de l�UITA pour l�Am�rique latine a �galement contribu� � la collecte de signatures (plus de 20 000 � ce jour) de p�titions demandant le maintien en activit� de la brasserie, et les affili�es de l�UITA dans la r�gion ont envoy� des messages de protestation � AmBev et au gouvernement d�Uruguay.

Monsieur le Directeur,

Nous avons �t� inform�s de la d�cision de la direction g�n�rale du groupe AmBev de fermer l�usine Norte�a situ�e � Paysand� en Uruguay, que le groupe avait acquise en 2000.

Au nom des 3 millions de travailleurs syndiqu�s de 124 pays regroup�s dans les 344 organisations affili�es � l�UITA, nous protestons vivement contre cette d�cision qui prive de leur emploi les quelque 200 salari�s/es de cette usine. Par ailleurs, cette d�cision va porter un coup suppl�mentaire terrible � une r�gion o� le ch�mage atteint d�j� 22% de la population active, et va certainement avoir des cons�quences graves sur l�activit� �conomique et donc les emplois dans d�autres secteurs.

Nous vous demandons par cons�quent de reconsid�rer d�urgence cette d�cision et de trouver une solution qui permette de maintenir l�activit� sur le site de l�usine de Norte�a.

L�Union internationale des travailleurs de l�alimentation, de l�agriculture, de l�h�tellerie-restauration, du tabac et des branches connexes (UITA) est une f�d�ration syndicale internationale qui repr�sente 3 millions de travailleurs/euses syndiqu�s/es regroup�s/es dans 344 organisations de 124 pays. Son secr�tariat r�gional pour l�Am�rique latine est situ� � Montevideo.

L�UITA consid�re que cette d�cision du groupe AmBev est extr�mement grave, non seulement pour les quelque 200 salari�s/es qui risquent de perdre leur emploi, mais aussi pour l��conomie et donc les emplois dans la r�gion o� le taux de ch�mage est de 22%.

Nous consid�rons qu�il est de la responsabilit� de l�Etat uruguayen de d�ployer tous les moyens possibles pour �viter la fermeture de l�usine de Norte�a et pour maintenir une activit� industrielle et les emplois sur ce site. Nous vous appelons par cons�quent � user de votre influence, Monsieur le Pr�sident, pour que des discussions soient engag�es avec la soci�t� AmBev sur l�avenir du site de Paysand�.
